Welcome to TinyStar Moments. These Terms of Service ("Terms") govern your use of our services and website. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.
1. Acceptance of Terms
By booking an event, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
These Terms constitute a legally binding agreement between you (the "Client") and TinyStar Moments (the "Company"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.
2. Service Description
TinyStar Moments provides professional children's event planning services, including but not limited to:
- Birthday party planning and coordination
- Themed event design and execution
- Educational workshops and activities
- Event decoration and setup services
- Entertainment coordination and management
- Photography and media services (as selected in package)
- Catering coordination (as selected in package)
Specific services included depend on the package selected and are detailed in your service agreement. All services are subject to availability and must be booked in advance.
3. Booking and Payment
3.1 Booking Process
All event bookings must be confirmed in writing via email or through our online booking system. A booking is considered confirmed only after we have received a signed service agreement and the required deposit payment.
3.2 Deposits and Payments
A non-refundable deposit of 50% of the total service fee is required to secure your event date. The remaining balance must be paid no later than 14 days before the scheduled event date. Failure to make timely payments may result in cancellation of services.
3.3 Accepted Payment Methods
We accept payments via credit card, debit card, bank transfer, and certified checks. All prices are quoted in Canadian dollars (CAD) unless otherwise specified.
4. Cancellation and Refund Policy
4.1 Cancellation by Client
- More than 30 days before event: Full refund minus deposit and 10% administrative fee
- 14-30 days before event: 50% refund of total amount paid
- Less than 14 days before event: No refund available
4.2 Rescheduling
Events may be rescheduled once without penalty if notice is provided at least 21 days in advance and subject to availability. Subsequent rescheduling requests may incur additional fees.
4.3 Cancellation by Company
In the unlikely event that we must cancel your event due to circumstances beyond our control, we will provide a full refund or work with you to reschedule at no additional cost.
5. Client Responsibilities
As a client, you agree to:
- Provide accurate information about the event, including number of attendees, age ranges, and special requirements
- Ensure the venue is accessible and available for our team during agreed setup and breakdown times
- Inform us of any allergies, dietary restrictions, or special needs at least 7 days before the event
- Supervise children attending the event and ensure appropriate adult-to-child ratios
- Respect our staff and treat them professionally throughout the event
- Comply with all venue rules and regulations
- Provide reasonable access to electricity, water, and other necessary utilities as required
6. Liability and Insurance
6.1 Our Liability
TinyStar Moments carries comprehensive general liability insurance for all events. However, we are not responsible for injuries, accidents, or damages that occur outside the scope of our direct services or due to client negligence.
6.2 Client Liability
Clients are responsible for the behavior and actions of all guests attending their event. Any damage to venue property or our equipment caused by event attendees will be the financial responsibility of the client.
6.3 Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government restrictions, or venue closures.
7. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of TinyStar Moments and protected by copyright laws. Our unique event themes, designs, and concepts are proprietary intellectual property.
Photography and video taken during events may be used by TinyStar Moments for marketing purposes unless you explicitly opt out in writing. Clients receive personal use rights to any media provided as part of their service package.
8. Privacy and Data Protection
We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to our collection and use of information as described in our Privacy Policy.
We implement reasonable security measures to protect your personal information but cannot guarantee absolute security of data transmitted over the internet.
9. Modifications to Services
We reserve the right to modify, substitute, or discontinue any aspect of our services with reasonable notice. If significant changes affect your booked event, we will notify you promptly and work to find an acceptable solution.
Minor adjustments to decorations, activities, or entertainment may be necessary based on availability, and we will always strive to maintain the quality and theme of your event.
10. Dispute Resolution
Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation. If resolution cannot be reached, disputes will be subject to binding arbitration in Quebec City, Quebec, Canada, in accordance with Canadian arbitration laws.
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
